These terms and conditions outline the rules and regulations for the use of Evergreen Hearts's Website, located at https://www.EvergreenHearts.org. By accessing this website, we assume you accept these terms and conditions. Do not continue to use Evergreen Hearts if you do not agree to take all of the terms and conditions stated on this page.

This document sets out the terms and conditions between Evergreen Hearts and you when you register for any event organized by Evergreen Hearts. By registering for an event organized by Evergreen Hearts you are agreeing to comply with these terms and conditions. You should read this document carefully.

Acceptance of Policies and Registration Conditions

The following Evergreen Hearts Registration Terms & Conditions (the “Terms & Conditions”) apply to all Evergreen Hearts events. Prior to your registration, you must acknowledge and accept the Terms & Conditions contained herein. Should you not wish to accept the Terms & Conditions you should not register.

Submission of a registration is regarded as affirmation of your acceptance of the Event Terms & Conditions.

Nondiscrimination Policy

Evergreen Hearts prohibits discrimination, harassment, and bullying against any person for any reason—for example, because of age, ancestry, color, disability or handicap, national origin, race, religion, gender, sexual or affectional orientation, gender identity, appearance, matriculation, political affiliation, marital status, veteran status, or any other characteristic protected by law.

Event Conduct and Safety

Evergreen Hearts is committed to providing a safe, productive, and welcoming environment to all participants, including staff and vendors, at Evergreen Hearts-related events. Evergreen Hearts has no tolerance for discrimination, harassment, or bullying in any form at Evergreen Hearts-related events. Participants are expected to adhere to these principles and respect the rights of others.

Participants should report any behavior inconsistent with these principles to onsite event staff. Event staff will be happy to help participants contact venue security or local law enforcement, provide escorts, or otherwise assist those experiencing harassment to feel safe for the duration of the event. We value your attendance.

Liability Waiver & Release

In consideration of being allowed to register for, and participate in the event, you hereby warrant and represent that you are age 21 or above and freely waive, release from liability, assume all risks, and covenant not to sue Evergreen Hearts or its members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, illness, including but not limited to COVID-19, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the event, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of Evergreen Hearts. This Liability Waiver and Release is specifically binding upon your heirs and assigns and is knowingly given.

Evergreen Hearts does not take any responsibility to personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.

Events

The event is subject to change without notice. Evergreen Hearts may postpone, cancel, interrupt or stop the event due to adverse weather, dangerous situations, epidemics, or any other reason beyond the control of Evergreen Hearts. If the event cannot be held or is canceled before the event commences for any reason beyond the control of Evergreen Hearts or its subcontractors, all reasonable efforts will be taken to reschedule the event. Under no circumstances will a refund be granted to a holder who is unable to attend a rescheduled event.

Some Evergreen Hearts events are social events where people can meet together in a safe and friendly environment. We pride ourselves in hosting well-organized events however we are not able to guarantee that any participant will successfully match with another participant. We are not a matchmaking service. We do not take responsibility for verifying the identity or background of any attendee at our events. We recommend that you verify their personal information with the same caution that you would exercise in any other situation.

Tickets

This ticket is a personal, revocable license. All tickets are non-refundable, and non-replaceable in the case of loss or destruction. Tickets are only valid on the event date. Unused tickets have no cash value. The price of the event ticket is non-negotiable. The bearer has to assume full responsibility for the ticket, once she/he/they receive it. Evergreen Hearts has no liabilities - financial, legal, or otherwise - in case the delivered tickets are stolen, lost, damaged, destroyed or rendered unusable in any other way.

Ticket transfers may be requested on business days (non-holiday weekdays), at least 24 hours prior to event start time. Ticket transfers are only available to transfer to another person for the same event. Ticket transfer requests must be emailed to info@EvergreenHearts.org from the email address listed on the ticket. Please provide all updated ticket details (full name, email, zip code) for the transfer request.

Kindly note that TicketTailor.com is the sole authorized source for purchasing event tickets. If you obtain your ticket(s) from any other unauthorized source, you take on the risks of those tickets turning out to be counterfeit or reported to be stolen. The issuer has the right to dishonor such stolen/counterfeit tickets and declare them as void.

The tickets delivered to you are not meant to be used for illegal reselling, copying, reproducing, or misrepresenting in any form. You cannot use the ticket(s) for any promotional/advertising purposes either (including sweepstakes and competitions) without our prior approval. Any proven record of such activities will result in immediate seizure and cancellation of your ticket(s).

At the time of entering the event venue, you are required to produce the ticket and a valid identification document (ID). By presenting an ID, you confirm that all details present on it are accurate and updated.

Please note that you purchase tickets on your own free will. As such, you do not have the right to initiate a chargeback claim or dispute on the provider of the credit card/debit card that had been used for the transaction. Further refund/return/cancellation requests will not be entertained either.

In all cases of disputes between the ticket-bearer and the ticket-issuer, the decision of the latter will be deemed final. In case a dispute cannot be resolved, the help of an independent third-party arbiter will be sought.

Evergreen Hearts reserves the right without refund or compensation to seize or cancel the ticket, withdraw the license granted above, refuse admission and/or expel a holder who damages the venue in any manner whatsoever and/or whose conduct is disorderly, verbally or physically abusive, disrespectful, harassing, poses a threat to security, or to the enjoyment of the event by others, or due to any violation of the conditions.

Refusal of Service

Evergreen Hearts reserves the right to refuse service to any person for any reason.

Prohibited Items

The holder agrees to submit to a reasonable search of his/her/their person and belongings prior to entry to the event to ensure compliance with these conditions. The following items are restricted, may not be brought into the event, and may be confiscated by Evergreen Hearts, its agents, subcontractors, and/or assigns: alcoholic beverages, illegal drugs or drug paraphernalia, weapons of any kind, and fireworks or firecrackers. The holder acknowledges that once admitted to the event, there are no in and out privileges, and smoking is only permitted in designated locations.

Insurance

It is the sole responsibility of the holder to arrange appropriate personal insurance appropriate or necessary in connection with their attendance at the event.

Service as an Invited Speaker

If you agree to speak at an Evergreen Hearts event, we may share your contact and biographical information with event attendees. Sometimes we may also request a photograph. In other cases, we post on the respective event website information such as your name, employer, as well as a link to your company website available to the public. This is so that visitors to the event website, including event attendees and speakers, can contact you with questions and requests for more information, and to provide feedback if needed.

Usage of Photographic and Video Material Taken at Evergreen Hearts Events

Evergreen Hearts imposes certain restrictions on the use of multimedia at its events (e.g. photography, video, audio, online streaming, and all future mediums). An attendee is permitted to use hand-held cameras and/or smart phones to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever.

Evergreen Hearts may hire professional service providers (photo/video/streaming/audio) to document and display the event experience. Evergreen Hearts may also use social media to: (i) post real-time photos and videos to its social media feeds; and (ii) display select submissions from those feeds on monitors throughout the event venue. Attendees and sponsors are encouraged to capture their event experiences and post their own social content from the event (text, photos, audio, video, streaming), provided it does not infringe upon the rights of any attendee, sponsor, third party, or Evergreen Hearts. Such infringement would include, but is not limited to, defamation or infringement of intellectual property rights. In the event an attendee requires a release or permission to protect the rights of a third party, obtaining such a release or permission shall be the sole responsibility of the attendee.

By attending the event, you acknowledge and agree as follows: (a) Evergreen Hearts may edit and use footage it captures at the event for marketing and promotional activities and for any other lawful purpose in the ordinary course of its business; and (b) due to the prevalence of mobile recording devices in today’s world, Evergreen Hearts disclaims all liability for the capture of your image in any multimedia format by other attendees at the event.

Evergreen Hearts makes no representations or warranties whatsoever about any of the content of this website or about the content of any other website which you may access by hypertext link through this website. When you access any other website by means of a link from this website you should understand that your access to that other website is independent of Evergreen Hearts and Evergreen Hearts has no control over the content of the web site, nor does Evergreen Hearts in any way endorse or approve the content of that website. In no event will Evergreen Hearts be liable to you or any other person for loss or damage (whether direct, indirect, special or other) for any use of this website or of any site linked to it by means of hypertext or otherwise.

If one or more of the conditions outlined in these Terms & Conditions should become invalid, the remaining conditions will continue to be valid and apply. These Terms & Conditions apply to all event participants (attendees, speakers, sponsors, exhibitors).

The views expressed by any event attendee, speaker, exhibitor, or sponsor are not necessarily those of Evergreen Hearts. All attendees, speakers, exhibitors, and sponsors are solely responsible for the content of all individual or corporation presentations, marketing collateral, and/or advertising.

The content of this website is the property of Evergreen Hearts.

You must not republish material from Evergreen Hearts. You must not sell, rent or sub-license material from Evergreen Hearts. You must not reproduce, duplicate or copy material from Evergreen Hearts. You must not redistribute content from Evergreen Hearts.
